Two copies of the will of Robert Maw Sr. have been consulted with reference to the names of at least some of his children. The first is the actual will as it appears on microfilm GS1 reel 541, Halton Surrogate Court, nbr. 342; and a copy of the will as it appears in Register A of the Halton County Surrogate Court, pages 500-502, nbr. 342. Note that the will is dated July 12, 1860; he died on June 7, 1861, but the will was not probated until July 12th, 1867, after the death of his wife Elizabeth.

The executors of the will were William and James Barber. William was the husband of Ann Maw, already deceased by the time her father wrote his will, and James Barber, husband of Maria Maw. In actual fact and according to the paperwork, it was James who handled the estate on behalf of the family.

Robert remembers first in his will his wife Elizabeth. Upon her death the residue of his estate was to be divided among his children.

The will names sons Thomas, Robert, James and Mark, and daughters Frances Thompson and Maria Barber.

Robert Maw Sr. must have enjoyed some material success in life. He seems to have held an interest in Esquesing Township North lot 18 on the 8th concession. This interest later became Georgetown village lots 63, 64, 65, 88, 89, and 90. These he left to his wife and upon her death the proceeds were to be passed on to his children. Also mentioned in his will was 50 acres of lot 3 in the 1st concession of Albion Township. His son Thomas Maw was only to receive a dollar from his estate for, it was stated, that he had already received his share. Thomas must have been successful as well, for in an 1877 gazetteer, he is said to have held the 50 acres in Albion, plus 175 acres in the Gore of Toronto. It may be that the Gore of Toronto information related to property held by father and son. (The abstract indexes have not been checked.)

One difficulty with the available records is the age of son Mark.

The age given on the transcription of the gravestone for Elizabeth, wife of Robert Maw Sr., suggests she was born in 1786 approximately. This is confirmed by the 1851 census in Gore of Toronto, Peel County. Elizabeth is in the household of daughter Frances Thompson when the enumerator called. She is shown as 65 which approximately computes with a 1786 birth. If this is so, then we have Mark Maw being born in approximately 1834. This would make Elizabeth approximately 48 when she had Mark, which seems a bit unlikely. She would have been perhaps 43 when son James was born and this is within the realm of possibility. Still, Mark is referred to as a son in Robert Maw Sr's will and treated as an equal so, until contrary information is found, he is shown as a son in this tree.

Looking over the years of birth of the children listed, it's probable that there were more children who didn't survive childhood.
